Terms of service.

Sigilia is a private platform that offers calculation, collection and filing services for the Romanian judicial stamp tax provided by Emergency Ordinance 80/2013. The service is offered to individuals, lawyers, notaries, bailiffs and legal entities who need to pay the tax and file the proof with the court.

The Sigilia platform is operated by Sigilia SRL, with its registered office in Romania (full registration details are being finalised). The operator is not the Ministry of Justice and does not act as a public authority. Payments are recorded into the statutory accounts of the beneficiaries.

The user enters the action type and, where applicable, the claim value. Sigilia shows the judicial tax, the service commission and the bank cost before payment confirmation. Payment is a single transaction via LibraPay. The proof of payment is generated as a PDF signed electronically with OneSpan, sent to the user's email and filed with the competent court.

The user undertakes to enter correct and complete data, to choose the action type matching their case and, for evaluable claims, to declare the actual claim value. The use of the platform is personal or professional within the scope of the legal or contractual mandate. Using another person's data without consent is prohibited.

Sigilia's liability is capped at the amount actually paid through the platform for the transaction at issue. Sigilia is not liable for a wrong choice of action type, for a misdeclared claim value, or for delays attributable to the court, to the bank processor, or to the electronic signature provider. Sigilia takes reasonable steps to keep the platform available but does not guarantee uninterrupted service.

The refund of the judicial stamp tax is handled under OUG 80/2013, art. 45. The refund request is filed with the court to which the tax was paid, together with the proof of payment. Sigilia assists the user by issuing a copy of the proof upon request, without replacing the judicial refund procedure.

Sigilia may suspend or terminate a user's access if these terms are breached, if there are reasonable fraud suspicions, or if the user operates contrary to the law. The user may cease using the platform at any time. Termination does not affect payments already recorded and proofs already filed.

These terms are governed by Romanian law. Disputes are resolved amicably; absent an agreement, the Romanian courts at the operator's registered office are competent. The parties may agree, in writing, to commercial arbitration within the limits set by law.

Sigilia may update these terms in line with legislative changes or service evolution. Substantial changes are announced at least 30 days in advance via a published version on this page and, for users with an account, a direct email notice.
