Judicial stamp tax for bailiffs: enforcement, contestation, incidental requests.

Bailiffs' work involves, beyond their own fees and advances for enforcement costs, a number of judicial fees owed in their own name or on behalf of the creditor. Emergency Ordinance 80/2013 groups them into three main categories: enforcement orders, contestations of enforcement, and incidental requests in enforcement proceedings.

For an enforcement order, article 2(2) of OUG 80/2013 sets a flat fee of 20 Lei. The tariff applies regardless of the value of the claim and is paid together with the enforcement-order request. For multiple requests (for example, an enforcement order over several assets), a single fee is owed.

The contestation of enforcement is regulated separately. If it concerns an enforceable title with evaluable value, the contestation is taxed at 50% of the fee that would have been owed by the title at first instance, but no more than 1,000 Lei. If it concerns non-evaluable enforcement acts (for example, an unlawfully imposed garnishment), the contestation is taxed at 100 Lei.

Incidental requests in enforcement proceedings (provisional suspension, reversal of enforcement, conservatory seizure requests) have their own tariffs: 20 Lei for non-evaluable ones, and the bracket-based fee for evaluable ones, but reduced to 50% under article 24.
