Law 268/2024: the corrections to OUG 80/2013, in detail.

Law 268/2024, published in the Official Gazette on 10 November 2024, made a targeted revision of Emergency Ordinance 80/2013. Unlike Law 199/2025, which reforms the update mechanism, Law 268/2024 directly corrects the fixed tariff values for several common actions.

The most visible change is at divorce. The fee for divorce by agreement, unchanged since 2013, rises from 20 Lei to 200 Lei. Contested divorce keeps its percentage-based tariff, but the minimum base increases to 200 Lei. For divorce through a mediator, the fee aligns with divorce by agreement.

Civil-status actions are also updated. Changing a name through administrative procedure stays taxed at 30 Lei, but the paternity action, previously a flat 20 Lei, becomes exempt through an extension of article 29 of OUG 80/2013. The action contesting paternity follows the same logic — exempt.

Presidential orders stay taxed at 20 Lei, but the law explicitly states that the fee is charged once, regardless of how many heads of claim are joined. Before Law 268/2024, practice was inconsistent; some courts charged the fee per head.

For claims with an evaluable value, Law 268/2024 changes neither the brackets nor the percentages. The only intervention on evaluable claims is a clarification of article 5: if the declared value is contested, the court can order an accounting expertise, and the fee difference is paid within 30 days of the decision.

For a lawyer or law firm handling routine litigation, Law 268/2024 is a mandatory update to the tariff memory. The Sigilia catalogue reflects the new values from the date the law took effect. For payments made before, the old values remain in force.
